1. Acceptance of Terms
By using any software, tool, or service provided by Custom Bots and Scrapers (each a “Service”), including any application that connects to a third-party platform on your behalf, you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Service.
2. Description of Services
Custom Bots and Scrapers develops custom software, automation tools, and integrations for individual clients, including tools that connect to third-party platforms (such as TikTok) via their official APIs to perform actions you have explicitly authorized, such as publishing content on your behalf.
Where a Service integrates with a third-party platform, that Service operates independently and is not affiliated with, endorsed by, or sponsored by the relevant platform (e.g., TikTok Inc. / ByteDance Ltd.) unless explicitly stated. Any trademarks referenced are the property of their respective owners and are used solely to describe compatibility.
3. Eligibility and Authorization
You represent and warrant that:
- You are at least 18 years old, or the age of majority in your jurisdiction.
- You own any third-party account (e.g., a TikTok account) connected to a Service, or you have explicit legal authority from the account owner to manage it and authorize the Service to act on its behalf.
- Any content submitted, published, or processed through a Service complies with the relevant third-party platform’s own terms of service and community guidelines, as well as all applicable laws.
You may revoke a Service’s access to a connected third-party account at any time, either through that platform’s own account settings or by contacting us.
4. Third-Party Platform Integrations (including TikTok)
Certain Services integrate with TikTok’s Content Posting API to publish video or photo content directly to a TikTok account, with the account owner’s explicit consent granted via TikTok’s OAuth authorization flow. Where this applies:
- Content is only published to the specific TikTok account(s) that have authorized the Service.
- We only request the minimum API permissions (scopes) required for the Service to function.
- You may revoke this authorization at any time from your TikTok account’s connected-apps settings.
- See our Privacy Policy for details on what data is collected, how it is used, and how long it is retained in connection with any third-party platform integration.
5. User Responsibilities
You are solely responsible for:
- The accuracy, legality, and appropriateness of any content submitted to or published through a Service.
- Ensuring you hold all necessary rights (copyright, trademark, likeness, or otherwise) to any content you submit.
- Any consequences arising from actions taken through a Service on a connected account, including actions taken by the third-party platform such as content removal or account restrictions.
6. Data and Privacy
Our collection and use of information in connection with any Service is described in our Privacy Policy. By using a Service, you consent to the data practices described there.
7. Service Availability
Services are provided on an “as is” and “as available” basis. We do not guarantee uninterrupted or error-free operation, particularly where functionality depends on the continued availability and stability of third-party platforms and their public APIs, which are outside our control. We reserve the right to modify, suspend, or discontinue any Service at any time.
8. Limitation of Liability
To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, revenue, or goodwill, arising from your use of or inability to use a Service, including any action taken by a third-party platform against your account as a result of content published or actions taken through a Service.
9. Termination
We may suspend or terminate your access to a Service at any time, with or without cause, including if we reasonably believe you have violated these Terms or a relevant third-party platform’s own policies. You may stop using a Service and revoke its access at any time.
10. Changes to These Terms
We may update these Terms from time to time. Material changes will be reflected by an updated “Effective Date” above. Continued use of a Service after changes take effect constitutes acceptance of the revised Terms.
11. Governing Law
These Terms are governed by the laws of the Republic of South Africa, without regard to conflict-of-law principles.
